Illinois Plaintiffs File Suit Against Vaginal Mesh Maker

An Illinois resident has filed a new lawsuit in the Circuit Court of Cook County, Illinois regarding complications related to vaginal mesh devices she was implanted with. The plaintiff, Rosemary Anderson, filed her lawsuit on the 15th of June, 2012, against defendants Dr. Rajesh Patel, Dr. Rao Uppuluri, Dr. Dorothy Anoina, Women For Women Health Care, Ethicon, Inc., and Johnson & Johnson, Inc. All of these parties, she claims, are responsible for the side effects she has experienced as a result of her use of a vaginal mesh device. She is accusing the defendants of negligence, insufficient warning of potential side effects, and failure to identify the vaginal mesh erosion she was undergoing.

Doctors denied mesh erosion

According to her lawsuit, plaintiff Anderson underwent a total hysterectomy and laparoscopic sacral colpopexy on the 16th of June, 2010. Defendants Patel and Anoina both performed part of the procedure. Anderson received a vaginal mesh implant known as the Prolene device, which is manufactured by Ethicon, Inc. She claims that the doctors Patel and Anoina continued to give her care but denied that she was experiencing transvaginal mesh failure or erosion. She claims that she was, in fact, experiencing erosion as a result of her implantation with the vaginal mesh device, and that the physicians had a duty to inform her of this fact which they did not do. She claims that they were also negligent in recommending the Prolene mesh device, which they allegedly knew came with serious risks associated with it.

She claims that Ethicon, Inc., the manufacturer of the device, and its parent company Johnson & Johnson knew or should have known about the high failure rates associated with the device but did not adequately inform her or other patients about the potential side effects.

Damages sought in lawsuit

Rosemary Anderson is seeking damages to cover past and future medical expenses, lost wages and/or lost earning capacity, disfigurement and disability, past and future pain and suffering, and emotional trauma. Her husband, Chuck Anderson, has filed as a co-plaintiff, claiming loss of consortium and conjugal benefits.
