Arizona Plaintiff Joins Chantix Alabama MDL

An Arizona plaintiff has filed a lawsuit in the ongoing multidistrict litigation case dealing with complications associated with the smoking cessation drug Chantix. Joseph Trimm, with the help of a personal injury lawyer, filed his lawsuit in the United States’ District Court for the Northern District of Alabama on June 15, 2012. This venue is where a number of similar lawsuits have been consolidated in the interest of speeding up the litigation process. Trimm claims to have experienced side effects including depression, hostility, and even attempted suicide as a result of his use of the popular medication.

Psychological Chantix injuries claimed

Plaintiff Trimm says in his lawsuit that he attempted suicide after Chantix use and experienced a number of other psychological complications as a result of his use of the drug. He says that in addition, he suffered depression, anxiety, and emotional distress after he bagnn taking the medication in December of 2008. His claims are not unlike a number of others that have been made in the Chantix MDL, which was formed in Ocetober of 2010. United States’ District Judge Inge P. Johnson is overseeing the proceedings and has recently chosen eight cases to proceed as bellwether trials, initial hearings that will take place and help both sides of the litigation judge how cases are likely to proceed.

The first bellwether trial is set to take place in October of 2012. Many plaintiffs who have chosen to file a Chantix lawsuit against drug maker Pfizer cite the Food and Drug Administration’s decision to add a black-box warning to Chantix packaging, outlining the risks of serious side effects like behavioral changes, suicide ideation, hostility, agitation, aggression, and depressed mood, as well as attempted suicide.

Counts of negligence brought against Pfizer

Plaintiff Trimm and his lawyer have brought counts of negligence, design defect, failure to warn, breach of warranties, fraudulent and negligent misrepresentation, concealment, gross negligence, unjust enrichment, and punitive damages against Pfizer. Damages will help cover medical bills, lost wages, and other financial losses associated with the side effects Trimm has experienced.
