Minnesota Yaz Lawsuit Joins Litigation
A new complaint has been filed in the District Court of Minnesota that deals with five plaintiffs who have filed suit after experiencing side effects of the oral contraceptive Yaz. These plaintiffs are seeking more than $75,000 in damages for the side effects they have suffered, which include blood clots and gallbladder disease. Failure to warn named in suit
The complaint, which was filed on the 24th of April, 2012, involves five separate plaintiffs who all claim to have suffered side effects after using the popular fourth generation birth control pill. The plaintiffs all claim that they were not adequately warned by the drug manufacturer about the potential risk of serious side effects associated with the medication, and claims that the defendant failed to warn patients about side effects even after reports about them were published in both Europe and the United States. In addition, Bayer marketed the medication as an effective treatment of acne and premenstrual dysphoric disorder, even though the Food and Drug Administration had not approved it for these uses.
Bayer was allegedly warned by the Food and Drug Administration three times, in 2003, 2008, and 2009, for overstating the benefits of the contraceptive while glossing over the potential risks. The Minnesota lawsuit claims that because of this, the plaintiffs were unknowingly exposed to risks that causes serious injury as well as pain and suffering and lost income among other side effects.
Settlement pursued by plaintiffs
The plaintiffs, four adults and one minor, claim that they suffered serious side effects of Yasmin or Yaz and are therefore seeking settlements as a result. Four plaintiffs are complaining of gallbladder disease as a result of their use of the medication, while one plaintiff suffered a pulmonary embolism after using Yaz. Each plaintiff claims that she suffered injury, pain, medical expense, and lost wages because of their use of Yaz, and are seeking thousands of dollars in settlement money.
