DePuy Executives to Testify in Ohio MDL
Eight current and former executives of DePuy Orthopedics, the device manufacturing company and subsidiary of Johnson & Johnson responsible for the manufacture and marketing of the ASR hip replacement device, are scheduled to testify at the ongoing Ohio multidistrict litigation concerning the device. The y MDL was established by the United States’ Judicial Panel on Multidistrict Litigation on December 7, 2010, in a move that combined federal cases dealing with the DePuy ASR hip replacement system and its side effects. The cases are overseen by the Honorable David A. Katz, and thousands of cases have been consolidated.
Plaintiffs are seeking compensation that would help cover injury-related costs, including medical bills and pain and suffering associated with their DePuy ASR hip replacement devices.
Executives set to testify
According to court documents, eight former and current DePuy executives are scheduled to testify, supplying information and knowledge about the ASR device which could help the lawsuits move forward. David Floyd, the U.S. and worldwide president of the company at the time of the DePuy implant recall which took place in August 2010 is among those scheduled to provide testimony, as is current DePuy president Andrew Ekdahl. These individuals and others involved in the development, research, and marketing of DePuy hip implants will be required to produce notes, documents, outlines, presentation materials, testimonies, and oral proposals that will further DePuy ASR litigation.
No settlements reached in MDL
A settlement was reached with DePuy’s parent company Johnson & Johnson and three plaintiffs who had filed a case in state court in Nevada, but at this point none of the over 6,000 lawsuits consolidated in the Ohio multidistrict litigation has reached a settlement with DePuy. The Nevada settlements amounted to an average of about 200,000 dollars per lawsuit, which is a significant sum that could help plaintiffs pay off medical bills and other costs associated with their injuries and revision surgeries.
