Louisiana MDL Gets New Actos Case
A new lawsuit has been consolidated along with dozens of others in the ongoing multidistrict litigation case. Pearl Green decided to file an Actos lawsuit on the 9th of March, 2012, in the United States District Court for the Middle District of Louisiana. Subsequently, her lawsuit was transferred to the multidistrict litigation case currently taking place in the Western District of Louisiana, Lafayette, on the 10th of April, 2012. The plaintiff, with the help of a lawyer, claims in her lawsuit that she developed side effects from Actos including bladder cancer after she began taking the medication. She says that her side effects resulting from Actos use are permanent and severe and says that she may require ongoing medical treatment in order to treat her symptoms. She is invoking Louisiana’s redhibition law.
Actos side effects and litigation
Louisiana’s redhibition law which is cited in this lawsuit is exclusive to the state and deals with protection of the consumer from and faulty or dangerous product. This is a legal term referring to the voiding of a sale due to hidden defects associated with the product. This law applied to anything that has been purchased in the state of Louisiana, including prescription drugs, which goes along with Green’s claim that she was unaware of the risk of developing bladder cancer as a result of her use of the medication. She says that drug maker Takeda should have warned her and other patients about the potential side effects associated with the medication, which has been suspended from pharmaceuticals markets in some places in Europe but continues to be sold in the United States.
Plaintiffs seek compensation for injuries
Green and other plaintiffs involved in bladder cancer litigation are seeking compensation for their injuries, medical bills, lost wages, and other costs associated with the side effects they experienced from their usage of the medication. Green is asking for more than $75,000 in compensation for her injuries.
